Getting a Green Card Through America Engagement

A citizen of the Republic of Turkey who is engaged to an American man can apply for a Green Card if he fulfills the necessary conditions . For this , the person who will apply for the US Green Card must first obtain a K-1 visa . According to the American Immigration Law; A U.S. citizen must complete Form I-129 (Petition for Immigrant Fiancée) for their fiancé and have the petition approved by the U.S. Citizenship and Immigration Service (USCIS). K-1 then engaged to non – US citizens can apply for a visa. With this visa, a person who goes to the USA can marry an American citizen fiancée within 90 days. During this 90-day period, he can work a job in the USA if he wants to. 

The person who marries his US fiancée can then apply for permanent residency with the Citizenship and Immigration Service (ISCIS) and the Department of Homeland Security . 

In the meantime , the person applying for a K-1 US Fiancee visa can apply for a K-2 Visa for children under the age of 21 and single children . For these people, the I-129 Form must be filled.

Requirements for a K-1 Fiance Visa

  • Requirement to be a US citizen: The person applying for a Green Card for his fiancee must be a US citizen.  
  • Requirement to have met in the last 2 years: The engaged couple must have met within 2 years before applying for a K-1 Visa also can remove conditions on green card but its just valid for certain situations. 
  • Requirement to marry within 90 days: Foreign fiancé must intend to marry within 90 days of entering the United States on a K-1 visa. The couple’s marriage must be legally possible under US law. 
  • Requirement to sponsor fiancee: A U.S. citizen must prove that he or she will take care of as many families as there will be after marriage, and that he or she has an income of more than 125 percent of the federal subsistence limit. If his income is below the subsistence minimum, another relative living in the United States must sponsor him. 

The engaged couple must present documents to prove that they have met before . (Flight tickets, hotel invoices, photos, photos taken with the couple’s family and friends, engagement rings, receipts for expenses made with the intention of marriage, letters showing the communication between them, correspondence such as e-mail)

Health Report: Regardless of age, the K-1 visa applicant must be examined by an authorized physician. The envelope containing the vaccination card and clean report issued by the authorized person must be submitted in the application. You must not open this envelope. 

Vaccination Cards: The applicant must go to a USCIS-approved clinic to have their missing vaccinations.  Financial resources: The US citizen should show his financial resources such as bank account, house, car, how to cover the expenses of his fiancee who will apply for a Green Card 

Workplace Letter: A letter from the workplace of the fiancee who will sponsor the visa applicant.

Tax Returns:  Receipts for taxes paid by a US citizen fiancé.
